JUZGADO LABORAL ACOGE DEMANDA DE DESPIDO INJUSTIFICADO POR LA CAUSAL DEL ARTÍCULO 161 INCISO 2 DEL CÓDIGO DEL TRABAJO

JUZGADO LABORAL CONDENA A CAJA DE COMPENSACIÓN POR DESPIDO DISCRIMINATORIO DE TRABAJADOR POR SU EDAD POR LA CAUSAL DEL ARTÍCULO 161 INCISO 2 DEL CÓDIGO DEL TRABAJO.


Estimados trabajadores, con fecha 16 de enero de 2020 el primer Juzgado de Letras del Trabajo de Santiago acogió la demanda de despido injustificado deducida por trabajador que fue despedido por la causal del artículo 161 inciso 2 del Código del Trabajo, es decir, fue desahuciado por la empresa, desahucio que no fue posible justificar ya que el tribunal estableció que el despido obedecía a un despido discriminatorio por la edad del demandante. 

La sentencia en análisis señaló que, la demandada actuó en forma discriminatoria al desvincular al trabajador por su edad, tras prestarle servicios por más de 36 años al aplicar una política para remozar una «organización añeja», como se expuso, el demandante sostiene que su despido obedeció a su edad, la que de acuerdo con el certificado de nacimiento incorporado era de 61 años al momento del despido. Sostuvo también que la empresa se encontraba en un proceso de reestructuración con una abierta política discriminatoria etaria, donde la mayoría de los despedidos, especialmente en cargos de jefaturas, responde a un perfil por sobre los 45 años, política de restructuración que buscaría mejores y mayores ganancias. Pero el elemento más propiamente indiciario de la política discriminatoria lo constituiría que la nueva administración habría manifestado que desea una institución más ágil, más ajustada a los tiempos.

Como podemos ver de lo ya señalado, el tribunal logró establecer que el trabajador si bien podía ser despedido por la figura del desahucio, la empresa por su parte no logró demostrar o acreditar las razones que dieron lugar al desahucio y de igual forma se pudo establecer que la empresa por medio del desahucio buscaba encubrir un despido de índole discriminatorio por la edad del trabajador, asunto que resulta completamente repugnante para el derecho.

De tal forma, el despido que no logre ser probado o que no esté suficientemente justificado en una carta de despido en virtud de la causal del desahucio, será declarado como injustificado y se deberá indemnizar al trabajador con un recargo legal equivalente al 30% respecto de la indemnización por años de servicio, es decir, aparte de las indemnizaciones legales por años de servicio, mes de aviso y vacaciones, el trabajador que demande a su ex empleador podrá obtener esta indemnización extra equivalente al 30% de los años de servicio, por la errónea aplicación de la causal del despido esgrimida para el caso en análisis y por su parte, al ser un despido discriminatorio y haberse ejercido una tutela laboral por vulneración de garantías constitucionales, se debe indemnizar al trabajador con 11 remuneraciones extras.

En relación a lo ya señalado, queda de manifiesto que resulta esencial frente a cualquier despido que el empleador haga entrega de una carta de despido al trabajador que logre satisfacer y hacer entender al trabajador los reales motivos que dieron lugar al despido, de tal forma que siempre ante cualquier despido independiente de la causal aplicada se debe analizar si realmente la carta cumple con describir de forma clara y precisa los hechos o si dichos hechos se ajustan a la verdad y la realidad, de tal forma que siempre ante cualquier despido se debe contactar a un abogado para que analice la carta y establecer si es una carta satisfactoria, en caso contrario, se debe demandar de forma inmediata por el despido injustificado y obtener las indemnizaciones que señala la ley por ser víctima de un despido injustificado o falto de verdad, lo anterior ya que como hemos indicado, lo señalado en la carta de despido debe ser probado en juicio y generar convicción suficiente en el juez respecto a la verdad de lo señalado para despedir al trabajador, en este caso además, se debe agregar que si existen motivos ocultos detrás del despido, como por ejemplo discriminación por edad, orientación sexual, nacionalidad, religión, ideología política, se debe demandar este elemento que no obedece a las capacidades o aptitudes del trabajador y obtener la indemnización de 11 remuneraciones por ser un despido vulneratorio de garantías constitucionales.

Por todo lo anterior, y como siempre les indicamos a todos los trabajadores de Chile si están siendo víctimas de un despido, no duden en contactarnos para recibir la debida asesoría y de esta forma demandar al empleador para la obtención de las indemnizaciones correspondientes por el despido injustificado.

No olvidar que para demandar se debe realizar la respectiva reserva de derechos en el finiquito, por lo tanto si es despido contáctenos a la brevedad para coordinar una reunión y de esta forma explicar los pasos a seguir para la realización de la reserva de derechos.
